Terms of service

The gist

This section is a summary, not a substitute for the rest. Use Ebbhaus for learning, not for anything harmful or illegal. What you upload stays yours; you give us permission to use it to teach you. If you subscribe, it renews until you cancel, and you can cancel at any time. The tutor is generated by software and can be wrong, so check anything that matters. We are a young company and we do not promise perfection.

Who we are

The service is provided by Ebbhaus, Inc. ("Ebbhaus", "we", "us"). These terms are the agreement between you and Ebbhaus, and they apply whenever you use the website, the product, or any application you connect to your account. Our privacy policy is part of this agreement.

By creating an account or using the service, you accept these terms. If you do not accept them, do not use the service.

Your account

You need an account to use the service. You are responsible for what happens under it, for keeping your sign-in credentials secure, and for the accuracy of the information you give us. One account is for one person; do not share it.

Minimum age

You must be at least 16 years old to use Ebbhaus, or older if the law where you live sets a higher age for agreeing to terms like these or for consenting to the processing of your personal information. If you are not, you may not create an account.

Subscriptions, fees and renewal

Parts of the service require a paid subscription. When you subscribe, you authorise us and our payment processor to charge the plan fee, plus any applicable taxes, on the interval you chose.

• Subscriptions renew automatically at the end of each interval until you cancel.
• You can cancel at any time from your account. Cancellation takes effect at the end of the interval you have already paid for; you keep access until then.
• Fees are charged in advance and, except where the law requires otherwise, are not refundable. We may make exceptions at our discretion.
• We may change our prices or plans. We will give you notice before a change affects a renewal, and the change takes effect at your next renewal, not mid-interval.
• If a payment fails, we may retry it and may suspend access until it succeeds.

Where you have a statutory right to withdraw from a purchase — such as the cooling-off period available to consumers in the European Union and the United Kingdom — that right applies and is not affected by anything in this section.

Your content

Material you upload, paste, write or otherwise provide remains yours. We claim no ownership of it.

To run the service, we need your permission to use it. You grant Ebbhaus a worldwide, non-exclusive, royalty-free licence to host, store, copy, process, transmit and display your content, and to create derived material from it — such as knowledge maps, questions and explanations — for the purpose of providing and improving the service to you. This licence exists so the product can function; it ends when you delete the content or your account, except for copies retained as described in the privacy policy.

You are responsible for having the rights to the material you provide. Do not upload material you are not permitted to use, and do not upload other people’s personal information without a lawful basis for doing so.

We do not use your content to train models for other customers, and our model providers are contractually prohibited from training on it.

What the tutor produces

Knowledge maps, questions, explanations, feedback and assessments are generated automatically, and they can be wrong — confidently wrong. Ebbhaus estimates what you know; an estimate is not a measurement, and it is not a qualification, a grade, or a credential.

Do not rely on generated material where being wrong would matter: it is not a substitute for a teacher, and it is not medical, legal, financial, or other professional advice. Verify anything consequential against a primary source.

Subject to the rights of others in any underlying material, you may use what the tutor produces for you however you like, including commercially. Similar material may be generated for other users.

Acceptable use

Do not use Ebbhaus to:

• Break the law, infringe anyone’s rights, or help anyone else do either.
• Upload malware, or material that is unlawful, abusive, or sexually exploitative of children.
• Attack, overload, probe or circumvent the service, its rate limits, or its security controls, except for good-faith security research reported privately to [email protected].
• Scrape the service, resell it, or use it to build a competing product.
• Extract prompts, models, or system instructions, or use the service to generate training data for another model.
• Impersonate anyone, or misrepresent your affiliation with a person or organisation.

We may apply rate limits and other technical restrictions to keep the service available for everyone.

Connected applications and third-party services

You can connect other applications and AI assistants to your account. When you authorise a connection, you are instructing us to share the information you approved with that application, and you are responsible for choosing to do so.

Those applications are not operated by us. Their own terms and privacy policies govern what they do with what they receive, and we are not responsible for them. You can revoke a connection at any time from your account.

Our intellectual property

The service — its software, design, and the Ebbhaus name and marks — belongs to us and our licensors. These terms give you permission to use the service; they do not transfer any of it to you.

Feedback

If you send us suggestions, we may use them without restriction or obligation to you. We appreciate them.

Suspension and ending your account

You can stop using Ebbhaus and delete your account at any time, from within the product.

We may suspend or terminate your access if you breach these terms, if we are required to by law, or if your use puts the service or other users at risk. Except where the breach is serious or urgent, we will tell you first and give you a chance to put it right. If we terminate your account without cause, we will refund the unused portion of any prepaid fee.

The sections on your content licence, disclaimers, liability, indemnification and governing law survive the end of this agreement.

Disclaimers

The service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the service will be uninterrupted, error-free, or secure, that any estimate the tutor produces will be accurate, or that using it will produce any particular learning outcome.

Some jurisdictions do not allow the exclusion of certain warranties. Where that is so, this section applies to the extent the law permits, and your statutory rights as a consumer are not affected.

Limitation of liability

To the fullest extent permitted by law, Ebbhaus will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising out of your use of the service.

Our total liability for any claim arising out of these terms or the service is limited to the greater of one hundred United States dollars or the amount you paid us in the twelve months before the claim arose.

Nothing in these terms excludes liability that cannot lawfully be excluded, including for fraud, or for death or personal injury caused by negligence.

Indemnification

You agree to indemnify and hold Ebbhaus harmless from claims, losses and reasonable legal costs arising out of your breach of these terms, your misuse of the service, or material you provided that you did not have the right to provide. This does not apply to the extent the claim arises from our own wrongdoing.

Governing law and disputes

These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. If you are a consumer, this does not deprive you of the protection of the mandatory laws of the country where you live.

If something goes wrong, write to [email protected] first. Most disputes are resolved faster by email than by anything else, and we will engage with you in good faith for thirty days before either of us starts formal proceedings.

If that does not resolve it, the courts of the State of Delaware have jurisdiction, and you and we both consent to their venue. Either of us may still bring an individual claim in a small-claims court, and nothing here prevents either of us from seeking an injunction to protect intellectual property.

Changes to these terms

We may update these terms as the service changes. The revision date at the top always reflects the current version, and changes apply going forward.

If a change is material and disadvantages you, we will tell you at least thirty days before it takes effect. If you do not accept it, you may cancel your subscription and close your account before it applies.

Miscellaneous

These terms and our privacy policy are the entire agreement between you and Ebbhaus about the service. If a court finds any part unenforceable, the rest stays in force. Our not enforcing a term on one occasion does not waive it. You may not transfer this agreement; we may transfer it in connection with a merger, acquisition or sale of assets.

You may not use the service where United States export controls or economic sanctions prohibit it.
